Buddy's Pizza ("Buddy's Pizza") is committed to treating the personal and corporate information of our users with respect and sensitivity. Our privacy commitment is described in this Privacy Policy (also referred to as the “Policy”).

Definitions
A. “You” and “your” mean the individual or entity visiting or using the Site.
B. “We,” “us” and “our” means Buddy’s Pizza.
C. “Site” refers to Buddy’s Pizza’s website at www.BuddysPizza.com, and other related websites, blogs, domains, and mobile sites maintained by Buddy’s Pizza.
E. “Non-Personal Information” is any information that is not Personally Identifiable Information (defined below).
F. “Personally Identifiable Information” or “PII” is non-public information we receive from your use of the Site that can be used, alone or in combination with other information in our possession, to identify a particular individual.  It may include information such as name, address, telephone number and other personal information you provide us.

Updates to the Privacy Policy
As our services evolve and we perceive the need or desirability of using information collected in other ways, we may from time to time amend this Privacy Policy. We post the effective date of our Privacy Policy on the Site. We encourage you to check our Site frequently to see the current Privacy Policy and Terms of Use in effect and any changes that may have been made to them. If we make material changes to this Policy we will post the revised Policy and the revised effective date on the Site. Please check back here periodically or contact us at the address listed at the end of this Policy for the latest updated Policy.

This Policy is part of and incorporated into by reference our Terms of Use Agreement (also referred to as “Terms”). Please click here to see that Agreement.

General Information
We believe that you have the right to understand how your information is stored and used. We require that sites linked to our Site contain a notice identifying their privacy policies. We are not responsible for the privacy practices of any third parties or the content of linked sites.  We encourage you to read the applicable privacy policies and terms and conditions of such third-party websites.  You understand that the privacy policies of third-party websites will govern the use of data collected on that site.

By using the Site, you are accepting the terms of this Privacy Policy.

Information You Provide Us
If you choose to register, and are 16 years of age or older, we will collect your name, date of birth, email address, and street address along with other information you may choose to submit, and you will choose a password as part of the registration process. If you make a purchase on our Site, we will also ask you for additional information including the credit card number and expiration date, billing address, shipping address, name on the account and telephone numbers for the billing and shipping addresses ("Credit Card Information").

For your security we do not keep or store your Credit Card Information after your purchase transaction is completed. We only share your Credit Card Information as necessary to complete your purchase transaction as disclosed in this Privacy Policy.

By providing your PII to us, you explicitly agree to our collection and use of such information as described in this Privacy Policy.

Information Automatically Collected
Because of the internet communications standards, when you visit the Site we automatically receive certain information from your browser or mobile device, such as your browser type, the operating system of your device, the URL of the site from which you came and the URL of the site you visit when leaving the Site.  We also receive your IP address and the name of your ISP or your mobile carrier.  Depending on your device’s settings, we may also receive location data and other types of information sent from third-party services or GPS-enabled devices.  As you use the Site, we may also collect information about such usage and your actions on our Site, such as pages you viewed, access times, and how long you spent on a page.  We may use cookies to collect such information, as described in more detail below.

We may use automatic data collection technology to record other information that identifies your device and tracks your behavior on the Site.  We may automatically receive and record information on our server logs from your browser, including your IP address, the pages you request, the pages you visited from our partner and affiliate websites and the products you viewed.

This information is considered Non-Personal Information, which we can use for any purpose, including to help us improve the Site and to enhance your and other users’ experience.  However, we will treat as PII any item that, either alone or together with other information, we could use to identify an individual.  For example, without your permission, we will not share with third parties the link between your IP address and your PII, except as described in the “Use of Information” section below.

Protecting Children's Privacy
We recognize that some of the users of our site may be under the age of 13 ("Minors"). We are committed to protecting Minors' privacy online and meeting the requirements of the federal Children's Online Privacy Protection Act. While we offer programs, such as the Email Club, only a parent or guardian may register a Minor in the program. We do not collect Personally Identifiable Information from Minors.

Although users 13 years of age or younger may be allowed to participate in some contests and promotions, if such a user wins, notification and prizes are sent to the parent or guardian identified in the initial registration process. We do not publish names, ages, or images for contest winners 13 years of age or younger without first receiving parental or guardian consent. 

If you have knowledge that a child 13 years of age or younger has submitted Personally Identifiable Information to us, please contact us.  If parents or guardians want to review, change, delete or disallow the further collection of their child's registration information, simply contact us.  A Minor’s parent or guardian may consent to Buddy’s Pizza collection of his/her PII and condition the collection on Buddy’s Pizza not disclosing the information to a third-party.  You may contact us via email or by clicking on the link on the registration page or by writing us at the address below. Parents and guardians can also telephone us at 800-965-0505, but before any information is disclosed the parent will be required to provide the parent's name and email address for verification. We will only send the information to the parent email address in the registration file.

We will never require the disclosure of a Minor’s personal information beyond what is necessary and then only with the consent of the Minor’s parent or guardian.

If a Minor who is not registered on our Site contacts Buddy's Pizza through an email, we will respond to that email on a one-time basis without obtaining parental consent and we will then delete the email address. We will not use that email address to contact the Minor thereafter. Our Site does not provide email services, chat rooms or message boards.

Cookies
We use cookies to personalize our Site for you and to collect aggregate information about site usage by all of our users. A cookie is a text file that our Site transfers to your computer's hard drive for record-keeping purposes and to enhance the quality of your visit to our Site. The cookie assigns a random, unique number to your computer. It does not contain information which would personally identify you, although we can associate the cookie with any personal identifying information that you provide us while visiting our Site. Our cookie records "clickstream" information (data reporting the URLs or names of the pages on our Site that you have visited).
We do not allow anyone else to access your cookie.

To help us optimize the Site, we may allow other authorized third parties to place or recognize unique cookies on your browser.  Any information provided to third parties through cookies will be for the purpose of enhancing your user experience by providing more relevant marketing.  Third-party services and tools we use and which may send cookies to users of the Site, and to collect certain information from users, include:

Google Analytics and Google AJAX Search API
Google Analytics and Google AJAX Search API collects information such as how often users visit the Site, what pages they visit when they do so, and what other sites they used prior to coming to the Site.  We use the information we get from Google Analytics only to improve the Site.  Google Analytics and Google AJAX Search API collects only the IP address assigned to you on the date you visit the Site, rather than your name or other identifying information.  You can review Google’s privacy policy at https://www.google.com/policies/privacy/ and http://www.google.com/intl/en/policies/privacy/.  We do not combine the information collected through Google Analytics with PII.  Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit the Site, the cookie cannot be used by anyone but Google.  Google’s ability to use and share information collected by Google Analytics and Google AJAX Search API about your visits to this Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy.  You can prevent Google Analytics from recognizing you on return visits to the Site by disabling cookies on your browser (see below).

Google AJAX Search API collects anonymous data (ad views, browser information, cookie data, date/time, demographic data, hardware/software type, internet service provider, interaction data, page views, and serving domains), pseudonymous data (IP Address (EU PII), search history, location based data, Clickstream Data, PII (name , address, phone number, email address, login, EU- IP address, EU-unique device ID ), sensitive (financial information).

Google Analytics and Google AJAX Search API shares aggregate data, PII and sensitive data with third parties. 

DoubleClick
DoubleClick (operated by DoubleClick) collects anonymous data (ad views, browser information, cookie data, date/time, demographic data, hardware/software type, internet service provider, interaction data, page views, and serving domains), pseudonymous data (IP Address (EU PII), search history, location based data, Clickstream Data, PII (name, address, phone number, email address, login, EU- IP address, EU-unique device ID), sensitive (financial information).  DoubleClick’s privacy policy can be found at: https://www.google.com/intl/en/policies/privacy/.  We do not combine the information collected through DoubleClick with personally identifiable information. 

DoubleClick shares aggregate data, PII and sensitive data with third parties. 

If you prefer not to receive cookies while browsing our website, you have the option to regulate the use of cookies through your Internet browser settings or other commercially available software. Doing so, however, may make some of our sites' features unavailable to you.

Do Not Track Notice
Your browser may provide you with the option to send a “Do Not Track” signal to websites you visit.  This signal is used to request that websites not send the requesting device cookies, but websites have no obligation to respond to such signal or to modify their operation.  At the current time, the Site is not programmed to recognize Do Not Track signals, so the Site will not treat you differently if we receive such signals from your browser and we may not comply with Do Not Track settings on your browser.

Use of Information
The information you provide will be subject to the Privacy Policy and Terms of Use in effect at the time you provided it to us. The provisions contained herein supersede all previous notices or statements regarding our privacy practices with respect to this Site and will be applied prospectively, not retroactively.  So for information collected or recollected after the effective date of this version of the Privacy Policy, the updated or revised Privacy Policy, at the time the information is collected or recollected, will govern our use of information.

We sometimes use aggregated data (independent of any personal identifiers) for research and commercial purposes. This information includes what areas or our Site users visit most frequently and what services they access most often. This information helps us develop a better site that is more useful and accessible to you.

We may use your PII internally, among other things, to offer our own or third party products and services that we think you may find of interest, but only Buddy's Pizza, its subsidiaries and contractors involved in distributing the offers or providing the products or services will have access to your PII. Our subsidiaries and contractors will be required to use any PII we provide them only for that intended purpose.

We may use your email address to contact you to respond to your inquiries or to provide information on products or services to you.

We reveal Personally Identifiable Information about you to unaffiliated third parties if: (1) you request or authorize it; (2) the information is provided to help complete a transaction for you; (3) the information is provided as we may in our sole discretion determine is necessary or reasonably required to comply with the law, applicable regulations, court orders or subpoenas, to enforce our Terms of Use or other agreements, or to protect our rights, property or safety or the rights, property or safety of our users or others (e.g., to a consumer reporting agency for fraud protection etc.); (4) the disclosure is done as part of a purchase, transfer or sale of services or assets (e.g., in the event that substantially all of our assets are acquired by another party, customer information may be one of the transferred assets); (5) the information is provided to our agents, outside vendors or service providers to perform functions on our behalf (e.g., analyzing data, providing marketing assistance, providing customer service, processing orders, etc.); (6) in special cases, such as in response to a physical threat to you or others, to protect property, or assert legal rights or defend ourselves in litigation; or (7) to others as described in this Privacy Policy.

If ownership of the Site changes, whether in whole or in part, information collected through the Site about you may be transferred to the new owner so the Site and any service provided through or related to the Site can continue.  In that case, your user information would remain subject to the terms and conditions of the applicable version of the Privacy Policy.

CAN-SPAM Compliance Notice
Buddy’s Pizza fully complies with the federal CAN-SPAM Act.  You can always opt out of receipt of further email correspondence from us.  You can elect not to receive emails from us either by so indicating at the time you register, "unsubscribing" to an email you receive or by contacting us as indicated below.

Exemptions from the Privacy Policy
The Privacy Policy does not apply to any information you may send to Buddy’s Pizza by email or instant messaging programs (e.g., AOL, Yahoo, etc.), or through social media networks, even if you open such programs or services by clicking a link displayed on the Site.  Email, social media, and instant messages are not recognized as secure communication forms.  Please do not send any information you consider private to us by email or instant message or through social media sites (e.g., Twitter, Facebook, etc.) due to the public nature of such postings.

Opt-Out, Access, and Security
If you do not wish to receive offers or other notices from us in the future, you can "opt out" by contacting us at the address indicated at the end of this Policy. In addition, if you provide us with PII, you will always have the option of requesting that the PII be removed from our system by contacting us at the address indicated at the end of this Policy.

Under Section 1798.83 of the California Civil Code, residents of California can obtain certain information from companies with whom they have an established business relationship.  That information is about the Personally Identifiable Information those companies have shared with third parties for direct marketing purposes during the preceding calendar year.  The law requires companies to inform consumers about the categories of Personally Identifiable Information shared with third parties, the names and addresses of those third parties, and examples of the services or products marketed by those third parties.  Although Buddy’s Pizza does not consider the California Civil Code to control its use of information collected on or through the Site and Buddy’s Pizza disputes any assertion that the California courts have jurisdiction over it, Buddy’s Pizza will nonetheless provide the foregoing information shared upon request by contacting us at the email address or street address provided below.

To review your PII, make any changes or corrections or to request that we remove your information, please contact us at the address listed below. We will try to complete your request as promptly as possible. Any changes will affect only future uses of your PII.

We use industry-standard, established security measures in place in our physical facilities and in our computer systems, databases, and communications networks that are designed to reasonably protect information contained within our systems from loss, misuse or alteration. However, no transmission of information is guaranteed to be completely secure. Unauthorized entry or use, hardware or software failure, and other factors may compromise data security. You acknowledge and agree to assume this risk when communicating with us.

Corporate Information
We also do not disclose your corporate information. We will not disclose any information that you provide us regarding your company as part of your registration except with your express consent or where necessary to provide you with a requested service. Our Terms of Use Agreement does not permit users of our Site to copy or use your corporate information to send you unsolicited communications or in other similarly improper ways.

However, we are not responsible for maintaining the confidentiality of any non-public information that you provide us. If there is information that you wish to protect from disclosure to others, do not provide it to us.
